S.G. HELIOSnet Limited (hereinafter referred to as "we", "us", "our") is a privately held, limited liability company registered in Cyprus with registration number HE 159214. We are operating the heliosnet.com online platform that provides services (collectively, the "Services") which allow prospective buyers or tenants of real estate properties to connect and negotiate with suppliers of relevant real estate properties. The Services are accessible at www.heliosnet.com and any other websites (collectively, the "Site") through which we make the Services available.
These Terms of Service (hereinafter referred to as the "Terms") govern your access to and use of the Services. By using the Services you agree to comply with and be legally bound by the Terms. The Terms constitute a binding legal agreement between you and us. If you are using the Services on behalf of a company or other legal entity, you represent and warrant that you are authorized to bind that company or other legal entity to the Terms and, in such event, "you" and "your" will refer and apply to that company or other legal entity.
You may use the Services only if you can form a binding contract with us and only in compliance with the Terms and all applicable laws. You acknowledge that it is your responsibility to ensure that the use of the Services is permitted under the laws of your jurisdiction and you agree to indemnify and hold us harmless if your use of the Services is in violation of local law.
You understand and agree that we are not real estate agents or brokers and we do not control any information about real estate properties that appear on the Site nor we are party to any negotiations or agreements related to the demand or supply of real estate properties that appear on the Site.
You understand and agree that we are providing the Services on an "as is" and "as available" basis. You expressly agree that your use of the Services is at your sole risk. You agree to indemnify and hold us harmless from any claim or demand arising out of your use of the Services or your violation of the Terms.
You agree to provide only true information when using the Services and you accept full responsibility for the information you provide including its accuracy, legality, reliability and appropriateness.
You understand and agree that we reserve the right to suspend or terminate your access to the Services if you violate the Terms or if we reasonably believe that your conduct may cause harm or liability to a user, third party or us (for example, by harassing, misleading others, attempting to engage in illegal activities or attempting to compromise the security and integrity of information systems).
When you buy credit units (heliolepta) you will be entitled to a cancellation period of fifteen (15) days (a "Cooling-Off Period") provided that (i) you have not expended any of the credit units (heliolepta) you bought; (ii) you have submitted a refund request within the Cooling-Off Period by clicking the following link after you login to your heliosnet.com account: https://www.heliosnet.com/b2b/hn5-user-ticket-add
Refunds are made via the same payment method that was used for the initial purchase.
Refunds can be completed only if the original payment method is still available and it allows refunds.
We require and store your email address when you create an account at the Site. We do not disclose your email address to anybody except our technical support department. We will only email you instructions and alerts relevant to your account.
We use secure session-cookies to provide the necessary functionality for the delivery of the Services. Session-cookies exist only in temporary memory while you are using the Services.
We store messages you send and receive via the Site. Only the recipient and the sender may view a message sent via the Site and nobody is allowed to modify such a message.
If you buy credit units (heliolepta), we require and store your name, address and VAT/TIC number (if applicable) so we can issue the relevant invoice. If you pay via card (credit or debit) we store the last 4 digits of your card. We do not disclose your billing data to anybody except our accounting and technical support departments.
When you use the Services, we automatically receive and store the following information for technical support and security purposes:We also use information about your interaction with the Services in order to detect, prevent and respond to fraud, abuse, security risks and technical issues that could harm us, our users, or the public.
We use Cloudflare to enhance the security, performance and reliability of the Services.
Google Maps Geocoding API is a Third Party Service that is used within the Services. Your use of the Services is subject to your acceptance of the Google’s Terms of Service and the Google Privacy Policy, as they may be amended by Google from time to time.
We reserve the right, at our sole discretion, to modify the Site, the Services or the Terms at any time. If we modify the Terms, we will post the new Terms on this page of the Site and we will update the "Last update" date at the top of the Terms.
You agree that the laws of Cyprus will govern the Terms and your use of the Services. Any dispute or claim shall be exclusively subject to the jurisdiction of the courts of Nicosia, Cyprus.
